dumping context here:
Current logic was not released, but has a few bugs that this patch should
address, and if not able to address in time for the May first free should be
moved to its own JIRA and fixed
* system key spaces are included in this check
* check is called outside of CREATE/ALTER KEYSPACE, which can cause a instance
to fail to startup
