I am certainly no legal expert, but if the code that resides in CVS complies with ASF requirements, how is it legally exposed?

Indeed --- this is absurd. We are all "legally exposed" every day of our lives --- Microsoft could sue us all, so could thousands of other entities. The question is: Is it probable? In this case, it hardly merits discussion, not to mention protracted debate.
