Yes, ordering of nested layers does matter in many cases.
For example when You want to send GetMap or GetLegendGraphic request for
group of nested layers and use their style parameter other than
'default'. In this case, You need to specify LAYERS and STYLES
parameters in URL for each nested layer. To get correct result, You need
to keep their order.
Adding one attribute to the ContentMetadata as suggested by Marcel
doesn't seem to complicate things - You can use that parameter or not.
