I have this bug too. In "desk 1" I have a top panel and bottom panel. In Desk 2 thru 4 I have an invisible top panel. If I add another panel, it comes in on the right. If I change its properties to top, it comes in as if below an invisible top panel. I have been experimenting with new settings in CompizConfig Settings Manager, and this started up right after that. Which desktop effects option are you asking about?
