OK, I think I fixed it, after sculking around the web, reading this, etc, I found a word document about serial ports, it is at http://www.akmcables.com/serial.doc - and it helped prompt me to look at ActiveSync connection settings. Sure enough, it had a checkmark in the box next to "Allow connections to one of the following" and COM 1 was selected.
Now when opening up hyperterminal or Ecom32 I don't get a warning that the selected com port is in use by another program, yeah, which one of about 30 on this machine do I look at.
