I think the DMCA could fall under a proper court challenge but I would like to have a couple of more Justices on the court who are young enough to at least understand the theory of programming a VCR. I don't mess with anything that requires decryption that involves my active involvement. Passive things like DVD players are OK. Besides if they are going to go after anyone for talking about the programs used for this someone like Leo Laporte would be high on that list. He has recommended the software to use on his radio show. The EFF and the ACLU would rally behind that sort of challenge.
