have a copyright on it, unless you release it.  But in these days of
digital media it is a mess once that copyright has been breached.

It's my understanding that the copyright laws for text/pictures/photos that are posted on the Internet may be different from other media [or less strenuously enforced]. Your members' posts may not be protected automatically unless specifically stated in the description and rules of your list. Is our list public or private? Who owns the list? Who hosts the list? What's their policy on privacy and copyright? Does the DMCA apply here? Or is that only for audio and video?
