No you are not a criminal, just a free loader.

Just because the author overlooked something is no justification for
not following the primary purpose of shareware. Some people try the shareware and never use it again, which is exactly the reason for the trial.

But if you
use it on a continuing basis, I would think your conscious would get the
better of you. Especially if you knew the program was good enough to
continue using.

Exactly that reason is why many put the watermarks or delays in their programs to prod people into contributing. And some just never update their program because they don't get anything for it. And some are not worth it but they die quite soon.
