Probably not in a purely legal sense. It has recently been made illegal to text and drive here in Virginia. There is a whopping $20 fine for doing so if one is ticketed. I really do not know why the state legislature even created that new law since the old faithful "failure to pay full time and attention" law has been on the books for years and years and carries a far heftier fine. Ah, now I see! By instituting this new law that is quite specific to texting, those drivers who are failing to pay attention because they are texting will be able to avoid the higher fines that will be meted out for those who are, say, reading a newspaper or watching a movie. Is this new law and attendant slap-on-the-wrist a sop to the cell phone industry that lobbied so intensely to keep the testing law from even getting out of committee?
