If I was a judge in this case my first query would be if this item is worth so much, money, market share..etc...why did you send some kid into a bar to leave it while he went out and took a leak in the alley? This super secret phone from Apple wasn't taken from Apple headquarters by a team of IMF agents, so I'd not let them prosecute like it was.
