This an informational question for the wise denizens of this list: What are some of the most prominent articles and/or books arguing that the Supreme Court should reverse or limit its decisions in cases like Vill. of Arlington Heights v. Metro. Hous. Dev. Corp. 429 U.S. 252 (1977), which makes it extremely difficult to win an equal protection challenge against a facially neutral statute allegedly enacted with discriminatory intent.
Cites to pieces defending the Arlington Heights doctrine are also appreciated. I am happy to receive replies off-list. Thanks for your help. Ilya Somin
