so the dirty workaround to this was

/bin/touch /etc/e-smith/web/panels/user/html/index.html
i tried a lot of things like copying the working file to the build server and
including it in a new archive.
doing a mock build with this worked. sending it to buildsys, failed with still
the double login.
tried this option and worked on few vms.
I do not want to lose more time on this so we will call it a fix.
