Whoa!  Hold up Chmouel!  The conflict IS <= kernel 2.2:
                                          ^

# rpm -q --conflicts -p initscripts-5.27-37mdk.i586.rpm 
kernel <= 2.2

If you try to install this with both kernel-2.2.17 and hackkernel-2.4.0
installed you get:

# rpm -Fvh initscripts-5.27-37mdk.i586.rpm 
error: failed dependencies:
        kernel <= 2.2 conflicts with initscripts-5.27-37mdk

but I think anyone with any kernel 2.2 and greater will get the same
error.
