I'm not a lawyer, but I think that whatever is the law applies, regardless of whether you put a notice like that or not... it really seems like a waste of bandwidth. Besides, this is the mailing list, so who is the intended recipient exactly? If a mail like this ever ends up in my mailbox, I will take it for granted that I was the intended recipient.
Anyway, there is a 'C-Kermit' (not 'kermit', so I'm not sure if this is what you are referring to) which, as far as I know, has never been included in Mandrake. You might be able to get away with minicom, which is in Cooker, depending on what you need it for. So, my suggestion is try minicom, and if thta fails you can pull C-Kermit from another RPM (I remember 'ckermit' being in 7.1 Contribs.
