There still are 2 copies of the aironet drivers in the kernel, one of which is
depreciated /lib/modules/kernel/drivers/net/pcmcia/airo and airo_cs
the ones that do need to be there are under
/lib/modules/kernel/drivers/net/wireless/airo*

with mandrake9.0 simply removing the offending driver fixed the problem.. but
under the mdk9.1 kernel pre3 the good driver has been compiled with a
different version of the wireless extensions that what the system is running

iwconfig's output below:

iwconfig Version 25
Compatible with Wireless Extension v15 or earlier,
Currently compiled with Wireless Extension v13.

eth1 Recommend Wireless Extension v12 or later,
Currently compiled with Wireless Extension v15.

wifi0 Recommend Wireless Extension v12 or later,
Currently compiled with Wireless Extension v15.

eth1 + wifi0 are both a single cisco aironet 350 card.

And one effect of this is that it is nolonger possible to use kismet. I think
it is because with the wireless extensions mismatch the driver can't properly
be put in promiscious mode.. Which was possible in mandrake 9.0 once the
bad driver was removed as stated above.
