Just a comment: I realize that we're in a open source community, and I haven't looked to see what kind of license Sam has placed on courier, but the majority of the banner is a copyright notice, and if he's put a copyright notice in the banner, it would seem to me that he's the ultimate arbiter as to whether a user of the product has the right to remove it. I would guess not. Even when software is under the GPL, a notice to that effect is part of the requirements of the license. Does that make sense?
