We regard that a digital photograph of a work of art, which is an immaterial item, represents the work of art and it is regarded as a reduced form of the sensory impression of the work of art; as such, given the tolerances of the pixel values of the image, it can be regarded to be an “incorporated” integral part of the complete sensory impression. This is also supported by the idea that the digital image could be reproduced from the sensory impression but not the complete sensory impression from the digital photograph.
