If it's acceptable to you to have a random address assigned to your VNIC if no factory addresses are available, then don't use the "factory" option. Use the default "auto" option. If the administrator specifically asks for a factory MAC address, I don't see why it would be a problem to fail that operation if no factory MAC addresses are available.
