I'm not sure this statement is as obvious as you think it is.
Legislation could help, or it could hurt.  Unrealistic,
unimplementable legislation enacted through ignorance might hurt less
than well-informed legislation.

Case law tends to be more reflective of reality, and there's becoming
more of that.
