In its Tuesday edition, the New York Times reports that the
new encryption rules will not be released this week, as
originally planned.

criticism that greeted a draft of the regulations when they were
released just before Thanksgiving. Critics said the draft fell far
short of White House promises to lift restrictions on the retail
data-scrambling products used to keep computer data and online
communications like e-mail private."

Those of us who have been following the Bernstein case will recall
that the government successfully requested a delay in the appeal to
the full 9th Circuit (to mid-March as I recall) as the new regulations
would affect the appeal process.
