The name I've used for this (attempted) defence is the Rumpelstiltskin defence, for reasons that should be obvious (and at some point I'll get around to finishing the writeup on this, which I get motivated to do every time I see someone advocate the Rumpelstiltskin defence as a strategy to use in court).
