The license will be public domain, as it is intended to be a tutorial, not a "product" (although i'll setup a game web also once it is ready to show).
On the other hand about your question, to create a map displayed in overhead style you simply place the camera looking down (or didnt i understand your question correctly). The populous (cspop) tutorial has a minimap with overhead view like described, but doesnt use overhead view in general. http://leapingcat.org/pablo/cspop23.png About the map, you probably want to use a terrain object, although a lot of ways to do it come to mind.
