No doubt, and yet as stated it is surely is a philosophical point. On the one side, there is your argument, and its a good one. On the other hand, any approach which works well and saves markup has its own merits and claims. I don't know of any markup which is designed specifically for this purpose, nor for doing screenplays, for example, and to that degree, one must "properly misuse" the available markup elements. Likewise, in this application, since the number is not properly part of the text, but is added for convenience, one could argue that <p> suffers the same problem to which you point: the number is not part of the paragraph, but <p> implies it is. Perhaps I am a troglodyte, but in my cave we get points for being utilitarian.
You could easily achieve the same thing by simply marking up the paragraphs as <p>'s and using a <span> with an assigned class to style each number. Better yet, designate each number as a header (<h2>, <h3>, whatever) and follow it with the paragraph. I think the header/paragraph would make the most sense in a non-visual way.
As regards the second, some of the documents have a hundred or more paragraphs, and as such, there could not be a one-for-one correspondence between <h1>...<h[x]> and that many paragraphs, unless I have misunderstood your thought...
As regards the second approach, it may have use and merit, but its not clear to me how to produce a paragraph with a hanging indent, so that one has what in essence has two columns where one is dedicated to numbering, and the other is dedicated to text, which scales well across a large range of font sizes, and which minimizes markup:
