I think David's point was that the kind of error you are seeing can often be caused by other unclosed tags and such, that will also trigger validation errors. The kind of thing you are talking about, for example could easily be caused by unclosed divs and the like.
It would be a good thing to clean up the errors, then see if you still have the problem... Just my $0.02, based on my similar experience.
