How does today's CIPA decision affect libraries? The decision by the three-judge federal panel permanently bars the federal government from requiring filtering in public libraries receiving E-Rate discounts for Internet access. That means that libraries will NOT have to filter to receive E-Rate discounts which begin in July (and remember, CIPA only applied to discounts from Internet Service Providers -- ISPs -- not discounts for telecommunications such as ISDN, POTS, or wireless). However, the decision will be almost certainly be appealed to the Supreme Court. It seems unlikely that the Supreme Court will take up the case until next year, since its current term ends in late June. Even if the Court upholds CIPA next year, filtering would probably not be required before July 2003.
