Dian,

 

Dale has asked me to respond to your question because I handle the day
to day process for lost items.

 

After an item has been declared lost and is $50.00 or more, I send out
two letters, one from me and one certified from the Library Director.
(Note) we always check the shelves before we begin the letter process or
send out any lost item notification. It is after I have received the
certified letter receipt or decline of the certified letter that I begin
the process for Municipal Court.

 

We have set the amount of $125.00 or more on lost items including the
processing fee before we send the customer to Municipal Court. 

 

 

I worked with the Municipal Court Clerk and we rewrote the "Affidavit of
complaining witness" to make it more applicable to a library situation.

 

I fill out all of the information on the affidavit.

I include a copy of the signed registration form and a copy of the lost
items

I submit all of the paperwork to Municipal Court. I must swear that the
information is correct and sign the papers in front of a witness.

The court sets up a court date for the customer

If the customers fails to appear at the pre trial court time, the judge
submits the customers information (birth date, TDL) to Omni Collection
for failure to appear. This process attaches the customer's driver's
license. This stops them from renewing their TDL until they clear their
account with the court. This process costs $30.00 per customer.

If I don't have their TDL and birthday then the prosecutor must issue a
warrant which will also stop the customer from renewing their license,
but this process costs $250.00.

 

If the customer clears their lost items with the library, then I send an
email to Municipal Court informing them that the customer has cleared
their record with us. We always communicate to the customer that they
must still appear in court at their appointed time and take care of
their court obligations. The total court cost is $125.00, $65.00 goes
back to the cities general fund and $30.00 is paid to Omni.

 

>From January 1, 2006 to December 31, 2006 we had 39 cases, 18 were
cleared with the courts.

 

We are presently trying to see if it would be possible for the courts to
collect what is owed to the library.

Dale, would you be willing to share the steps your library goes through
to have a stop put on a patron's driver's license until their fines
and/or lost books are returned.  We have gone to petty court to get
patrons to return items or pay for them; however we did have a good
return for our time.
