Surplus plane scam convictions net two prison terms

TUCSON, Ariz. -- Rejecting a defense
claim that the government withheld information
about alleged CIA ties to an exchange program
for surplus military planes, a federal judge
Wednesday denied a new trial and sentenced its
two key figures to prison for conspiracy.
U.S. District Judge William Browning
also rejected motions for acquittal or for a
new trial based on contentions that the court
or prosecution committed a series of errors in
its prosecution of Roy D. Reagan and Fred A.
Fuchs.
He sentenced Reagan to 2 1/2 years in
prison and Fuchs to prison two years for
conspiring to steal 28 surplus military
aircraft that were swapped for far less
valuable historic planes. A jury convicted the
two in the fall. Both men will appeal.
The program devised by Reagan, an
aviation broker from Medford, Ore., and Fuchs,
retired assistant director of aviation for the
U.S. Forest Service from Los Lunas, N.M.,
sought to funnel retired aircraft to private
companies holding contracts with the Forest
Service to fight forest fires.
The government claimed the surplus
planes were worth $22 million, but the judge
valued the aircraft at $400,000 for sentencing
purposes.
Assistant U.S. Attorney Claire Lefkowitz
told Browning that Fuchs has "accepted no
responsibility" and Reagan "still doesn't get
it."
Browning recommended that Reagan and
Fuchs serve their time at the minimum-security
federal prison facility adjacent to Nellis Air
Force Base. He ordered them to report by May
4. Each also received three years' probation.
Reagan's lawyer, A. Melvin McDonald, a
former U.S. Attorney for Arizona, contended
that a key government witness, William Eck,
had CIA ties that the government should have
revealed.
He also contended that the Justice
Department hid information about Heavylift
International, a Sparks company where Eck
works and reputed to have done intelligence
work for the U.S. and British governments.
But Lefkowitz denied the Eck was a CIA
operative and said Heavylift International was
not to be confused with a company in England
with a similar name, Heavylift of England. She
said her investigation revealed "no evidence
of any CIA involvement in the case."
