There was a court session Friday the 9th of April, but the jury was
not present. A small fight broke out as Sanders attorney told Judge
Seybert that they planned to call Sanders previous attorney as a
witness for the defense. The prosecution objected, but Sanders
attorney won that argument. Sanders previous attorney will appear
in court on Monday morning. It�s possible that the jury will get
the case for their deliberations sometime on Tuesday.
I�ve been closely following the prosecution�s argument that Terrell
Stacey was somehow forced to supply the residue laden fabric
samples to James Sanders. The reason the prosecution has to prove
that Sanders forced Terrell Stacey to furnish the fabric samples to
Sanders is Sanders First Amendment rights as a journalist would not
be protected.
If the prosecution can not prove that Sanders forced Terrell Stacey
to supply the fabric samples to Sanders then the governments case
will fail in getting a conviction of the Sanders.
>From reading about Terrell Stacey, I�ve learned that he is a very
straight forward, honest man. A man who follows the rules because
he understands why there are rules. He strikes me as a person who
would be upset if he saw what he perceived as a sloppy and possibly
corrupt investigation into an aircrash where 230 lives were lost,
with many of the victims being his friends.
Terrell Stacey was already upset with the way the NTSB
investigation was going before he and James Sanders ever met. You
might make the argument that Terrell Stacey would have told someone
else about his concerns of how the NTSB investigation was going had
he not met James Sanders.
While reading a government affidavit concerning the Sanders, I
found it interesting that Terrell Stacey gave some reports to James
Sanders describing the location of the TWA Flight 800 wreckage as
it was found on the ocean floor. This has since come to be known as
the �TAGS� database. This was before Terrell Stacey obtained and
mailed some red residue laden fabric samples to James Sanders at
his home in Virginia.
This action by Terrell Stacey shows me that he knew what he was
doing when he furnished the first confidential materials to James
Sanders. Terrell Stacey was not in any way forced to provide the
confidential materials to James Sanders. This is a perfect example
of how a �source�, Terrell Stacey, conveys confidential documents
to a �journalist�, James Sanders. If the journalist asks the source
to provide proof of alleged wrong doing by the government to the
journalist, it is not a conspiracy to steal by the journalist.
James Sanders examined the TAGS database closely and after
constructing a special chart which was constructed using the
information present on the TAGS database, he saw some debris
patterns that made him sit up and take notice. James Sanders told
Terrell Stacey about his findings and that he thought that
something had passed through the passenger cabin in a right to left
direction (almost inline with the leading edge of the wings).
Terrell Stacey told James Sanders about the seats in rows 17
through 19 with the red residue on the seat fabric, they (the
seats) were right where James Sanders had indicated when he was
describing the fuselage damage to Terrell Stacey.
At this point James Sanders asked Terrell Stacey if he could
provide a sample of the fabric with the red residue so he could
have some tests run on the fabric sample to see if it bore out his
hunch that the red residue might prove to be from rocket motor
exhaust.
Terrell Stacey on his own volition obtained some fabric samples
from the Calverton hangar complex and mailed the samples to the
home of James Sanders. I don�t understand how Terrell Stacey was
�forced� by James and Elizabeth Sanders into obtaining the seat
fabric samples.
While looking at the court documents which describe the charges
made by the government against Terrell Stacey and the Sanders, I
was puzzled as to why the charges were different for Terrell
Stacey, when compared to the charges for the Sanders. The following
are the charges as found on the governments affidavit.

New York, the defendant TERRELL STACEY did knowingly and
intentionally steal, purloin and convert to his own use and the
use of another, and without authority did dispose of, a thing of
value of the United States and a department and agency thereof, to
wit: pieces of the wreckage of TWA Flight 800, the value of which
did not exceed One Thousand Dollars ($1000). (18 U.S.C. &&641 and
3551 et seq.)

JAMES KINSLEY, being duly sworn, deposes and states that he is a
Special Agent with the Federal Bureau of Investigation ("FBI"),
duly appointed by law and acting as such.
In January 1997, within the Eastern District of New York and
elsewhere, the defendants JAMES SANDERS and ELIZABETH SANDERS,
and others, did knowingly, intentionally and without authority
remove, conceal and withhold parts of a civil aircraft involved in
an accident and removed property on the aircraft at the time of the
accident.
(49 U.S.C. & 1155(b); 18 U.S.C. &2.)
Terrell Stacey took the same piece of wreckage from the crash of
TWA Flight 800 as James Sanders received (from Terrell Stacey). Why
wasn�t Terrell Stacey charged with the same crime as the Sanders?
Our Justice system works in strange ways. First the government
tried to get James Sanders to give up his source inside the NTSB
investigation with the promise of little or no prosecution. James
Sanders refused , following his journalistic instincts. Then when
the government uncovered Terrell Stacey as Sanders �Hangarman� they
did the same thing. They went easy on Terrell Stacey in order to
get James Sanders. The government also went after James Sanders
wife Elizabeth just for good measure.
Sanders court trial continues on Monday morning the 12th of April.
