HCA To Pay $840M for Fraud Claim

WASHINGTON (AP) _ HCA-The Healthcare Company, the nation's
largest for-profit hospital chain, agreed Thursday to
plead guilty to defrauding government health care programs and
will pay more than $840 million in criminal fines, civil
penalties
and damages.
The FBI in Tennessee has scheduled a news conference regarding
the criminal investigation for Friday in Nashville. An FBI
agent reached by phone wouldn't specify the reason.
The agreement _ reached after a seven-year federal investigation
triggered by private whistleblowers _ is the largest government
fraud settlement ever negotiated by the Justice Department.
The company agreed to cooperate with a continuing investigation
that Attorney General Janet Reno said could still produce
criminal charges. Deputy Assistant FBI Director Thomas Kubic
called the case ``one of the FBI's highest priority white-collar
crime investigations.''
The agreement did not settle civil allegations that HCA inflated
charges to the government and paid kickbacks to doctors so
they would refer Medicare and Medicaid patients to its
facilities.
The two HCA units that pleaded guilty _ Columbia Homecare Group
Inc. and Columbia Management Companies Inc. _ agreed
to pay more than $95 million in criminal fines and were barred
from further participation in federal health care programs.
Separately, HCA agreed to pay $745 million in civil penalties for
its alleged false billing practices _ a figure negotiated last
spring
but not finalized until the criminal settlement was announced
Thursday.
``Health care fraud impacts every American citizen,'' Reno told a
news conference. ``If you overbill the U.S. taxpayer, then we
are going to make you pay it back and then some.''
She said it was the largest health care fraud investigation in
history. It involved 30 U.S. attorneys' offices, 22 FBI field
offices, inspectors general from the Health and Human Service
Department and the Office of Personnel Management, Defense
Department investigators and state fraud units.
HCA co-founder and chief executive Thomas Frist Jr., the brother
of U.S. Sen. Bill Frist, R-Tenn., said from the company's
Nashville headquarters: ``Today's action represents one of the
last steps needed to put the Columbia investigation behind us and
allows us to move forward, maintaining our focus on providing
quality patient care.''
Frist ousted Richard L. Scott as chief executive in July 1997 and
began a restructuring of the company. HCA got out of the
home health care business and sold or consolidated more than 100
hospitals. The chain currently has about 200 hospitals.
Reno said the civil settlement covers allegations the company
overbilled government health care programs for services it
performed, charged for services it did not perform and for costs
that were not eligible for reimbursement.
In the criminal case, the two units agreed to plead guilty to
filing false cost reports; fraudulently billing Medicare for home
health care workers and management and wound care center workers;
fraudulently billing Medicare and other health programs by
inflating the seriousness of pneumonia diagnoses; paying
kickbacks in the sale of home health agencies; and kickbacks to
doctors to refer patients.
The guilty pleas will be filed in Miami, Atlanta, Nashville,
Tampa, Fla., and El Paso, Texas.
Assistant Attorney General David Ogden said that $731.3 million
of the civil settlement would to go the federal government, but
some portion of that, up to a maximum of 25 percent, would be
allocated through negotiations to private whistleblowers _ 29
have been identified publicly. ``Whistleblowers brought valuable
information to the attention of the U.S. government,'' Ogden
said.
An additional $13.6 million of the civil settlement will be
distributed to state governments for their share of losses under
the state share of the Medicaid program.
The company, formerly known as Columbia/HCA Healthcare Corp., was
alleged by whistleblowers and others in the health
industry to have defrauded Medicare, which covers the elderly;
Medicaid, which covers the poor; Tricare, which covers the
military and their families; and the Federal Employees' Health
Benefits program, which covers civilian federal workers.
Stephen Meagher, a San Francisco attorney who represents several
HCA whistleblowers, described the settlement as ``pretty
mind-blowing.''
John Schilling, one of the whistleblowers, was a key witness and
provided documents in a 1999 criminal trial that resulted in
prison sentences for two mid-level HCA executives in Florida.
They are appealing. Another executive was acquitted and a
fourth pleaded guilty after a hung jury to avoid a second trial.
There have been no criminal convictions of any top HCA
executives.
Shares of HCA were down 22 cents to close at $38.54 on the New
York Stock Exchange.

*1 The medical malpractice and outrageous conduct claims involved
in this appeal stem from the hospitalization of
an elderly patient for total hip replacement surgery. The
patient, [FN1] her two sisters, and her caretaker sued the
hospital and its nursing staff in the Circuit Court for Davidson
County alleging that their lack of appropriate care
caused the patient to enter a vegetative state and caused severe
emotional stress to the patient's sisters and
caretaker.
Alta M. Knight was a 76-year-old retired budget analyst. On
January 7, 1993, she was admitted to Centennial
Medical Center in Nashville for major surgery on her fractured
left hip. Ms. Knight tolerated the total hip
replacement surgery well; however, her course of recovery
following surgery was difficult. Her condition
eventually stabilized, and she was discharged from the hospital
on February 1, 1993.
On January 7, 1994, Ms. Knight, her two sisters, and her
caretaker filed suit against Centennial Medical Center
and unknown members of its nursing staff. The complaint alleged
that the negligent care of the hospital's
"employees and/or agents" caused Ms. Knight to sustain anoxic
injuries while hospitalized that eventually caused
her to fall into a vegetative state. The complaint also alleged
that the hospital's neglect of Ms. Knight's physical
condition immediately following surgery was outrageous conduct
that caused them mental anguish and depression.
Ms. Knight's estate and her sisters and caretaker responded to
the summary judgment motion with three
affidavits. In the first, Ms. Knight's caretaker stated that the
sight of Ms. Knight seven hours after surgery "tied to
a gurney, naked and with dried vomit on her body" caused her to
suffer "mental anguish, recurring nightmares and
severe depression." In the second affidavit, a recovery room
nurse employed at another hospital opined that Ms.
Knight "was not a good candidate for elective surgery," that her
treating physicians should have conducted a
preoperative "independent medical evaluation," and that a "fluid
overload" caused congestive heart failure,
pulmonary edema, and aspiration which resulted in permanently
injuring Ms. Knight. In the third affidavit, an
orthopaedic surgeon from Georgia stated that Ms. Knight's
anesthesiologist and surgeon had deviated from the
standard of care "by failing to stabilize her medical status
prior to the hip arthroplasty" and that their actions
"resulted in medical complications following her hip surgery."

record-keeping and care of Ms. Knight immediately
following surgery.
The plaintiffs' recovery room nurse stated that the hospital's
nurses breached the applicable standard of care by
not keeping adequate written records of Ms. Knight's condition
between 8:00 p.m. and 10:00 p.m. following her
surgery and by leaving her unattended tied to a gurney with dried
vomit on her body.
*7 The remaining malpractice claims relate to the nurses'
record-keeping and care of Ms. Knight immediately
following surgery.
The plaintiffs' recovery room nurse stated that the hospital's
nurses breached the applicable standard of care by
not keeping adequate written records of Ms. Knight's condition
between 8:00 p.m. and 10:00 p.m. following her
surgery and by leaving her unattended tied to a gurney with dried
vomit on her body.
The undisputed evidence before the court was
that the recovery room staff was required to restrain Ms. Knight
because she became very restless and
disoriented in the surgical intensive care unit. Her caretaker
insisted on visiting her there and observed her in the
restraints and also observed that she was unclothed and that she
had dried vomit on her body.
*8 Seeing her employer and friend in this condition must have
been unsettling to Ms. Knight's caretaker, as it
would have been to any person unfamiliar with the condition of
patients immediately following surgery. It does not
follow, however, that Ms. Knight's condition in the recovery room
or the hospital's decision to permit her
caretaker to visit her there constitutes legally actionable
outrageous conduct. We concur with the trial court's
conclusion that Ms. Knight's condition in the recovery room, as
described by her caretaker, does not rise to the
level of outrageous conduct.

Doctors Are The Third Leading Cause of Death in the US,
Causing 250,000 Deaths Every Year
This article was in the Journal American Medical Association,
documenting the tragedy of the traditional medical paradigm.
This information is a follow-up of the Institute of Medicine
report which hit the papers in December of last year,
but the data was hard to reference as it was not in peer-reviewed
journal. Now it is published in JAMA which is
the most widely circulated medical periodical in the world.
The author is Dr. Barbara Starfield of the Johns Hopkins School
of Hygiene and Public Health and she describes
how the US health care system may contribute to poor health.
ALL THESE ARE DEATHS PER YEAR:
12,000 -- unnecessary surgery
7,000 -- medication errors in hospitals
20,000 -- other errors in hospitals
80,000 -- infections in hospitals
106,000 -- non-error, negative effects of drugs
These total to 250,000 deaths per year from iatrogenic causes!!
If the higher estimates are used, the deaths due to iatrogenic
causes would range from 230,000 to 284,000. In
any case, 225,000 deaths per year constitutes the third leading
cause of death in the United States, after deaths
from heart disease and cancer. Even if these figures are
overestimated, there is a wide margin between these
numbers of deaths and the next leading cause of death
(cerebrovascular disease).
Another analysis 11 concluded that between 4% and 18% of
consecutive patients experience negative effects in
outpatient settings, with:
116 million extra physician visits
77 million extra prescriptions
17 million emergency department visits
8 million hospitalizations
3 million long-term admissions
199,000 additional deaths
$77 billion in extra costs
However, evidence from a few studies indicates that as many as
20% to 30% of patients receive inappropriate care.
An estimated 44,000 to 98,000 among them die each year as a
result of medical errors.2
This might be tolerated if it resulted in better health, but does
it? Of 13 countries in a recent comparison,3,4 the
United States ranks an average of 12th (second from the bottom)
for 16 available health indicators. More
specifically, the ranking of the US on several indicators was:
13th (last) for low-birth-weight percentages
13th for neonatal mortality and infant mortality overall 14
11th for post neonatal mortality
13th for years of potential life lost (excluding external causes)
11th for life expectancy at 1 year for females, 12th for males
10th for life expectancy at 15 years for females, 12th for males
10th for life expectancy at 40 years for females, 9th for males
7th for life expectancy at 65 years for females, 7th for males
3rd for life expectancy at 80 years for females, 3rd for males
10th for age-adjusted mortality
The poor performance of the US was recently confirmed by a World
Health Organization study, which used
different data and ranked the United States as 15th among 25
industrialized countries.

LONDON, ENGLAND - Harold Shipman was being called the "Angel of
Death" by a patient just weeks before
he died following a visit from the GP, the inquiry into the
serial killer has heard.
'Organised murder'
Shipman "moved unchecked through families, streets and bit-by-bit
murdered the heart of a community," Richard
Lissack, QC, representing local families, told the inquiry.
DR Shipman, 55, is serving life for murdering 15 women patients
of his one-man practice in Hyde. But the former
doctor, who was convicted in January last year, is feared to have
killed hundreds during his 20 years as a GP.

Shipman was described by Mr Egerton as "arrogant." The former
doctor is now serving life for the murders of 15
of his female patients who were killed with lethal injections of

1990s, during a turbulent period of labor
complaints and recriminations among rival scientists there,
documents from an internal Army inquiry show.
The 1992 inquiry at the Frederick facility also found evidence
that someone was secretly entering a laboratory
late at night to conduct unauthorized research, apparently
involving anthrax. A numerical counter on lab
equipment had been rolled back to hide work done by the mystery
researcher, who left the misspelled label
"antrax" in the machine's electronic memory, according to the
documents obtained by The Hartford Courant.

reveal how shockingly vulnerable the
capital is to an anthrax attack. Rob Evans investigates

It was lunchtime on London's Northern line. Deep underground,
passengers were getting on and off the tube
trains as normal.
Two men boarded a train at Colliers Wood in south London. As the
train gathered speed towards its next stop,
Tooting Broadway, one of them got up from his seat and dropped a
small carton of face powder out of the
window. He could have been idly throwing away litter.
As the train sped on, the carton hit the tracks and burst. Out
spewed millions of tiny spores, which began to
spread throughout the dark tunnels. Dust swabs taken after three
days and two weeks showed that the spores
had spread as far up the line as Camden Town station in north
London, 10 miles away.
This really happened. But the two men weren't terrorists but
government scientists. And the spores weren't
anthrax spores, but a harmless micro-organism designed to mimic
clandestine sabotage with anthrax. This was an
official experiment in 1963, and it showed how easily saboteurs
could inflict a potentially devastating attack on
Britain's capital.
If there had been real anthrax in the carton, many thousands of
passengers would have started to inhale the
spores, which would have lain undiscovered for some time. The
hardy spores can survive for months. Once
inhaled, the spores germinate, producing living anthrax bacteria
that multiply rapidly. But it can take up to two
months for symptoms to appear.
They would then have suffered fever, headaches, chills, chest
pains and other symptoms. Some would have
appeared to recover, but then almost all would have died
abruptly, after quickly developing lung and brain
damage and internal bleeding. London would have been gripped by
chaos and panic as ministers tried to find out
what had happened.
Documents obtained by the Guardian show how scientists secretly
conducted a series of trials in the 1950s and
1960s to assess how easily saboteurs could spread deadly germs -
and terror - among Britons. Their conclusions
make disturbing reading. The trials clearly demonstrated that
Britain was highly vulnerable to such a covert strike.
"The potential for clandestine biological warfare attack is
considerable," the scientists wrote. For many people,
that warning now carries more weight than ever; fears of
bio-terrorism have grown markedly since September
11, with Americans especially jittery.
Yesterday, the US government launched a criminal investigation
into the outbreak of anthrax in a newspaper
office in Florida after it was detected in a third person. The
bacteria was found in the nose of an unnamed
35-year-old woman. The US attorney general, John Ashcroft,
cautioned that there was still no evidence that the
cases were caused by terrorists.

Project SHAD: American Servicemen Used As Guinea Pigs
Project SHAD, an acronym for Shipboard Hazard and Defense, was
part of the joint service chemical and biological warfare test
program conducted during the 1960s. Project SHAD encompassed
tests designed to identify US warships' vulnerabilities to
attacks with chemical or biological warfare agents and to develop
procedures to respond to such attacks while maintaining a
war-fighting capability. Although classified, the Department of
Defense has been actively pursuing declassification of relevant
medical information. To date twelve SHAD projects have been
evaluated and released for your review.
The SHAD program planned as many as a hundred individual tests
and was part of the larger Deseret Test Center program. Many
tests were never actually executed. DoD investigators plan to
look at all Deseret Test Center�s chemical and biological tests
conducted between 1963 and 1970
Of the 4,300 sailors known to be involved, to our knowledge, only
622 have been notified.
Project 112 Fact Sheets to be Released Assistant Secretary of
Defense (Health Affairs) William Winkenwerder, Jr., will hold a
news conference to release 28 detailed fact sheets on 27 Cold
War-era chemical and biological warfare tests identified as
Project 112. The briefing will take place tomorrow, Oct. 9, 2002,
at 1 p.m. EDT in the DoD Briefing Room, Pentagon 2E781. These
documents will supplement information already posted on the World

Hi, folks. Welcome to our monthly feature, "That Time of the
Month." In about two months (when my schedule
quiets down), this feature will become a monthly streaming video
piece. Until then, I will offer my thoughts in text.
Here we go:
"GERMS IN THE WHITE HOUSE"
I know you can't threaten the president, and God knows I would
never do that. That would be stupid and crazy
and of course, morally wrong, not to mention legally wrong. No
one should ever threaten the president. I think it
might also be illegal to say that you merely wish him some sort
of terrible harm. Some forms of harm, of course,
being more illegal to wish than others. You could never, for
instance, mention guns or bullets. That would be not
only be illegal, it would be wrong and dangerous.
And if you did such a foolish thing, I believe "they" (the men
with no expressions on their faces) would come to
your house and pay you a visit �just to check you out thoroughly
and make sure that, even though you wished the
president some harm, you wouldn't actually go about causing it
yourself. Wishing is fine, doing is not. Especially
wishing out loud.
And I certainly would never wish a president any sort of harm
�out loud. It's not in my heart to do such a thing
�to any human being. I wish all people only the best at all times
�out loud. Especially the president. Because
even though I disagree with his policies, and think he is a
dangerous imbecile, he is, after all, the President of all of
us, and he is a fellow human being, deserving of respect. (That
was hard to say, but I wanted to keep the record
straight.)
But I want to say that I do enjoy it when other people create
mischief. I like to read about mischief.
I especially like those terrorist fellows in the Middle East who
run around blowing themselves up along with other
people; they strike me as interesting guys. And pretty soon
they'll graduate from simple explosives to more
interesting and sophisticated things like germs and chemicals.
That will really be fun. Especially for a guy like me
who enjoys chaos and disorder.
Do you think the men with no expression on their faces would come
to my house if I merely said that it would be
fun to read that an Iraqi terrorist (trying to get even for
something or other that he imagines might have happened
in the 90's) left a big bag of anthrax germs in the White House?
You know, just some guy on the White House
tour leaving a big bag of germs on a table? Metal detectors have
a hard time detecting bags of germs, don't they?
Would it be illegal to say that? Would the expressionless men
come to my house if I said that? I guess I'll find out.
