Un-Constitutional Expenditures By Bob Ellis � Human Events recently published a report on the <A HREF="http://www.humanevents.org/articles/03-10-03/outrageous.htm";>Ten Most Outrageous Government Programs</A>. It´s sad that Human Events could find enough material to put this list together, and sadder still that this list was not compiled by Congress and then handled appropriately.The programs identified in this report were included because they did not have a mandate to exist from the U.S. Constitution. You see, our Constitution defines not only our values as a people, but sets boundaries for our government. The founders knew all too well that a government which was too big, unrestrained and unaccountable, could be the enemy of freedom. The Constitution was set up not so much to enumerate the rights of individuals (Ninth Amendment) as to limit the powers of government. The Tenth Amendment says: > “The powers not delegated to the United States by the Constitution, nor > prohibited by it to the states, are reserved to the states respectively, or > to the people.” The majority of people in government today act as if this amendment did not exist. It was quite clear to most people for the majority of America´s history that unless the Constitution specifically stated the federal government could or should be doing something, that the government should NOT be doing it. That has been twisted in modern thinking to mean, “If the Constitution doesn´t specifically prohibit an action, then the government can do it.” This is a direct and egregious perversion of our Constitution! In “ The Life of Colonel David Crockett,” there is a story of how Congressman Crockett exercised what he had learned about limited government. Once, there was a bill before the House to appropriate money for the widow of a distinguished naval officer. It seemed that everyone would vote in favor of it until Crockett spoke: > “Mr. Speaker — I have as much respect for the memory of the deceased, and > as much sympathy for the sufferings of the living, if suffering there be, > as any man in this House, but we must not permit our respect for the dead > or our sympathy for a part of the living to lead us into an act of > injustice to the balance of the living. I will not go into an argument to > prove that Congress has no power to appropriate this money as an act of > charity. Every member upon this floor knows it. We have the right, as > individuals, to give away as much of our own money as we please in charity; > but as members of Congress we have no right so to appropriate a dollar of > the public money…We have not the semblance of authority to appropriate it > as a charity. Mr. Speaker, I have said we have the right to give as much > money of our own as we please. I am the poorest man on this floor. I cannot > vote for this bill, but I will give one week's pay to the object, and if > every member of Congress will do the same, it will amount to more than the > bill asks.” There was another earlier account in that story where Crockett actually learned his lesson after voting for a bill to appropriate $20,000 for the victims of a fire in Georgetown. Crockett, caught up in the emotion of the situation, voted for the measure, which later failed. It was not until re-election time that a constituent reminded him that he had no Constitutional authority for such a measure. When the constituent had finished explaining this to him, Crockett had to admit he was wrong, and apologized to his constituent, pledging never to vote for an unconstitutional measure ever again.Oh, if we only had men of this caliber in Congress today! If we did, we would have more freedom, a better society, and more money in the pockets of the people who earned it. There would be greater innovation in our businesses and greater productivity in our workers. There would be less corruption in government and more responsible decisions by our elected officials. It is pathetic that Republicans were either behind or signed 8 of the 10 into law. Many congressional Republicans these days hold themselves up as defenders of the Constitution and many are, but obviously the Republican Party does not have a distinguished track record in this regard. The Legal Services Corporation, number one on the list, was Richard Nixon´s baby. This organization exists ostensibly to provide for the legal needs of the poor (think back to the Davey Crockett story), but in fact promotes a political agenda at taxpayer expense. Why do we taxpayers need to pay for a group which tries to keep criminals from being evicted from public housing and helps illegal aliens get government handouts? The Legal Services Corporation is costing the taxpayers money in more ways than one! And it has no Constitutional right to exist!Then there´s the Campaign Finance Reform Act (a.k.a. the Incumbent Protection Act, a.k.a. the First Amendment Curtailment Act), pushed by Republican John McCain and signed into law by Republican George W. Bush. Incidentally, this bill does none of the things President Bush said it would have to in order for him to sign it. Why he trashed his credibility by going back on his word and signing this into law is anybody´s guess. The legislation is widely expected to fail the test of Constitutionality when it eventually comes before the Supreme Court. To their shame, many members of congress who voted for it now say they had no idea what the bill contained.We mustn´t forget the Endangered Species Act under Nixon which has single-handedly ham-strung countless business endeavors and cost untold amounts to private property owners as they saw their land suddenly become useless; in effect, the government seized their land without recompense. These egregious violations of property rights (dare I go so far as to say human rights?) are done to protect animals which lack intelligence and a soul. The Bible says G-d gave dominion of the earth and all the animals on it to man, but the U.S. government has superseded this gift from G-d. What incredible arrogance!Amtrak, the government-run railroad signed into law by Nixon, is perhaps one of the best examples of why the government should leave most endeavors to the private sector. Someone thought it would be sad to have the passenger rail system disappear in America, and sought to have the government interfere with the natural evolution of the economy. Any other railroad would have to operate in such a way as to generate a profit, or succumb to market forces. But in typical government fashion, Am track continues to exist as a black hole into which our tax dollars are sucked, never to escape.Last on the list is “Welfare for Non-Citizens.” How wrong can it possibly be to rob the taxpayers to pay people who took the time to come to this country and then can´t or wont´ support themselves? Welfare itself is unconstitutional (again go back to the Davey Crockett story) and should be left entirely in the hands of private churches and charities. The government is inherently incapable of making the moral distinctions and discriminations necessary to ensure that people who are unable to take care of themselves are (1) helped, if the problem was through no fault of their own, or (2) taught the error of their ways and given incentives to make responsible decisions. There are a number of “Dishonorable Mentions” at the bottom of the report, many of which are arguably as laughably unconstitutional as those in the Top 10. Americans should be outraged at the behavior of their government, and should hold them accountable. But sadly most Americans are too ignorant to realize how badly they´re being ripped off. And many of the others don´t care, being on the receiving end of much of the government largesse. Over 200 years ago, historian Alexander Tyler made a chilling prediction about America: > “…A democracy cannot exist as a permanent form of government. It can only > exist until the voters discover that they can vote themselves largesse from > the public treasury. From that moment on, the majority only votes for > candidates promising the most benefits from the public treasury, with the > result that a democracy always collapses over loose fiscal policy, always > followed by dictatorship.” Did you know that you spend more time working to pay your taxes than did the serfs under feudalism in old England? Did you know that your taxes are higher than those that drove a group of patriots to lead a rebellion against, among other things, King George´s overtaxation? How can the chains of bondage to a government rest lighter upon our wrists than they did on the wrists of the patriots of 227 years ago? Can it be apathy? Ignorance? A healthy dose of both?Those of us who love the America that was, the America that should be, the America that can be, have a responsibility to educate and motivate the public about this. We also have a duty to hold our public officials accountable for their oath to the Constitution. I, for one, will do everything I can to meet this obligation.
