Anon This article from the weekly Montana Bitterroot Star details an unusual occurrence where in a lawsuit against Marc Racicot brother Chris, four Montana Supreme Court Justices reecuse themselves,perhaps because ethics moneylaudering judicial discipline charges have been filed against Republican National Chairman Marc Racicot for money laundering drug money in 2 Swiss Accounts from a bank that he owned, Norwest Bank. Haynes Sits in place of Chief Justice by Michael Howell Bitterroot Star March 5, 2003 Hamilton, Montana www.bitterrootstar.com Ravalli County District Court Judge James Haynes has been ordered to sit in place of Supreme Court Chief Justice Karla Gray in a case from which the Chief Justice has recused herself. The case is unusual in that four of the seven justices of the Montana Supreme Court have recused themselves and been replaced in the case. Aside from Gray, Justices Cotter, Nelson, and Treiweiler have also recused themselves from the case. "It is unusual for this many judges to be recused on a single case," said Chief Justice Gray, "It looks weird, but it isn't. There is nothing nefarious going on here." Although the justices are not required to explain or even comment on their reasons for recusing themselves, most of the justices, in this case, have offered a response. Gray said that she had a social relationship with one of the parties involved and though it shouldn't interfere with her judgement in the case, she prefers to avoid even the appearance of a conflict of interest. Justice Cotter's husband is an attorney for one of the parties involved. Justice Nelson also said that that he had a social relationship with an attorney for one of the parties that led him to recuse himself to avoid even the appearance of a conflict. The case before the court was filed by Jeffrey and Cindy Vader against Christopher Racicot, Asset Advisory Group,LLC., Horner,Townsend & Kent Inc. (HTK). Metropolitan Investmnt Securities, Inc. (MIS) and John Does A through Z, inclusive. The Vaders alledge Racicot falsely represented to them that he was a registered investment advisor. their suit sets out claims for violations of the Montana Securities Act, negligent misrepresentation and constructive fraud, common law bad faith, negligent and intentional infliction of emotional distress, and punitive damages. According to District Judge Thomas Honzell's ruling in the case, dated June 11, 2002, Racicot and Asset Advisory Group were served but failed to appear and their defaults were entered. HTK and MIS both filed motions to dismiss which were denied for failure to file supporting briefs. MIS then filed its motion to compel arbitration and to stay proceedings which had been joined in by HTK. Judge Honzel in his ruling agreed to compel arbitration and stay proceedings. The Vaders appealed Judge Honzell's order to the Supreme Court. Aside from local District Judge Haynes, who has been ordered to replace Karla Gray on the case, District Judge Mike Salvagni will sit in place of Justice James Nelson, and District Judge Gary Day will sit in place of Justice Terry Treilweiler. Haynes said that the case may be interesting to those with an interest in technical matters of law and that he considered his service on the highest court in the state to be "a wonderful oppurtunity". ------------------------ Yahoo!
