Diana's death likened to MI6 plot

MORE than six years after the deaths of Diana, Princess of Wales, and Dodi Al-Fayed, the questions surrounding the Paris car crash in which they were killed continue to grip the public imagination.
The Court of Session in Edinburgh became the centre of international attention yesterday as Mohamed al-Fayed, the owner of Harrods, pursued his search for the truth about how, or why, his son and Diana died.
"I have been fighting for six years, but I can see the light and justice can be done. What I am doing is for the nation and for the ordinary people ... Eighty-five per cent believe Diana was murdered with my son."
The court heard Mr Fayed�s counsel contend that he had "substantial grounds" for fearing that the British security services were implicated. The crash, it was claimed, had "striking similarities" to an earlier MI6 plot to remove Slobodan Milosevic, then president of Serbia.
Colin Boyd, QC, the Lord Advocate, has refused an inquiry into the crash, but Mr Fayed maintains that as a resident of Scotland, at Balnagown Castle, Kildary, Easter Ross, he is entitled to secure his rights under the tenets of the European Convention on Human Rights (ECHR).
Mr Fayed argues there should be an effective, official inquiry when someone appears to have been killed as a result of the use of force and is asking Lord Drummond Young to set aside the Lord Advocate�s decision as incompatible with the ECHR.
Richard Keen, QC, for Mr Fayed, said that the official line from the French police after the crash in a tunnel in Paris in the early hours of 31 August, 1997, was that it had been an accident caused by Henri Paul, assistant head of security at the Ritz hotel and the driver of the Mercedes the couple died in. The French police said Mr Paul was drunk and on anti-depressants at the time of the crash. Mr Paul also died in the incident.
"He [Mr Paul] had been in the Ritz Hotel for two hours before he left and is recalled by all those who spoke with him as being entirely sober," said Mr Keen. He said British and American security services were monitoring Diana and Dodi in the month leading up to their deaths and that Henri Paul may have been an MI6 informant.
And on the night of the crash Mr Paul had taken a "highly unusual route" from the Ritz to Dodi�s apartment.
The QC said pieces of a broken tail-light, from a white Fiat Uno, had been found at the scene of the crash, and there were marks on the bumper of the Mercedes.
Inquiries had "led to the suggestion" that the driver of the Fiat might have been James Andanson, a member of the paparazzi who had been pursuing the couple that summer, although he denied being in Paris that night. In 2000, Mr Andanson�s body was found. It was initially treated as murder, but then was declared to have been suicide.
Mr Keen said there had been reports of a flash of light in the tunnel, which would have blinded a driver.
A former MI6 agent had said the circumstances bore "striking similarities" to a plan in 1992 to assassinate Milosevic. The agent had also revealed that MI6 had an informant on the security staff at the Ritz Hotel. After the crash, it was learned that Mr Paul had 13 bank accounts containing more than a million francs.
"It might suggest he had at least some kind of part-time job," said Mr Keen.
Diana had expressed fears for her safety, and Mr Keen added: "If her fears had only one ounce of truth in October 1996, one is entitled to ask how much greater they may have been in August 1997 when the general anticipation was that a person denigrated by sections of the establishment was about to become stepfather to the future king," said Mr Keen.
Mr Keen said Diana and Princes William and Harry were being monitored from around 10 July, 1997, when they arrived at the Fayed estate in St Tropez in the south of France.
After the couple arrived at Beauvais airport on August 30, Mr Keen told the court, "as a matter of practice French security reported the arrival of the Princess to the UK embassy assuming they were not aware of it.
Mr Keen added that the US National Security Agency has confirmed the Princess was the subject of monitoring at the time of the crash.

BRITAIN is, at last, giving the late Princess what her memory is owed - the respect and right to a full inquest.
It is about time.
Six years has been a suspicious period of time to wait for this announcement and all talk of "regret" by the coroner over this ludicrous delay cannot excuse the inexcusable.
The inquest should have taken place years ago when witnesses' minds were fresh and evidence was new.
We must ensure a 2004 hearing into a 1997 tragedy doesn't have its potential force weakened by the passage of time.
For that reason, while welcoming this development, none of us should get carried away with the news the inquest will open on January 6.
It would be far too easy and convenient for royal coroner Michael Burgess to go through the motions and effectively concur with the French inquiry findings that the Princess died from massive chest injuries after a car crash in Paris.
It is imperative the scope of this new hearing on British soil goes much further than merely examining the cause of death.
This inquest should be a thorough and searching examination of the circumstances leading up to the death, even if that requires flexibility in the inquest procedures in this wholly exceptional case.
Only that way can all the questions be answered and the doubts finally cleared up over what happened during that journey into the road tunnel on August 31, 1997.
After spending so long dragging their feet and stalling for time, the British authorities cannot afford to settle for rubber-stamping the salient facts and terrible injuries suffered by the Princess and Dodi al Fayed.
Despite the French inquiry, far too many disturbing questions remain.
Were there mysterious flashes in the tunnel moments before impact? Was the driver, Henri Paul, a paid MI6 agent? Were the toxicology tests surrounding his alcohol levels accurate?
Why were no tyre brake marks found from the Mercedes which apparently lost control?
If there are straightforward answers and reasonable explanations, the British people have a right to know and be reassured.
The British system cannot be seen to hold an inquest which fails to address the fundamental issues at the heart of the accident. Polls show 90 per cent of people believe the Princess was murdered, so the coroner will require a deft and probing hand if he, and the inquest, are to emerge with any credibility.
The intensity of feeling has no doubt been stoked by the letter which I reproduced in October in my book, A Royal Duty.
In the letter, written ten months before her death, the Princess said: "This particular phase in my life is the most dangerous," and she said an accident was being planned in her car where brake failure and serious head injury would result "in order to make the path clear for Charles to marry".
Those words became a chilling premonition, written by a woman who knew she was being monitored (because an ex-MI5 officer told her) and so worried for her safety she wrote down her fears as "insurance".
That letter took on a disturbing significance the moment the Mercedes smashed into the 13th pillar of the road tunnel, killing the Princess and Dodi al Fayed.
It might only be evidence of the state of the Princess's mind in the final months of her life but it nevertheless increases the huge public interest which is crying out for a full examination of the facts.
I have been criticised for waiting six years before revealing the contents of the letter. But armed with such dynamite, I truly did not know what to do with it.
Give it to the Windsors and it would have been archived, never to be seen by the public. Give it to the Spencers and it may have been shredded. Give it to the police and, again, it may never have seen the light of day.
My intention had always been to hand over that letter the moment a British inquest was announced.
So the question is not why it took me six years to produce that letter but why it has taken six years for an inquest to be held, thereby giving me the chance to place it into a legal arena. It was only when I was writing A Royal Duty in the summer that I decided to include that letter because no inquest date had been announced, even though plans had been mooted.
Yesterday I was in Tokyo explaining to the Japanese media of the urgent need for an inquest into the tragedy.
I now feel my duty was right in reproducing that letter when I did because it has dragged the Princess's death back into the spotlight and made the case for an inquest even more compelling.
Now Mr Burgess should do his duty - and answer the disturbing questions once and for all.
