--- Begin Message ----Caveat Lector- Yesterday the NY State Senate voted for the 3 misdemeanor arrests and you go to prison law I've been warning about for the past two years. This NY Post article mentions rapists as the target of the bill so the public will not feel threatened by the serious implications of this law or get who it is really aimed at. Virtually all vending violations are misdemeanors, as are most other arrestable offenses in NYC, including protesting, posting a leaflet, disorderly conduct, jaywalking, drinking a beer on the street, marijuana possession, fare beating and even some littering and traffic violations. If the NY State Assembly votes for this as well, three vending arrests will get you sent to prison for 1 1/3 years. The judge will for forced to give you this sentence, just like under the Rockefeller Drug laws. If they pass Intro #48 or the disabled veteran vendor restrictions, art vending in a Park or on a restricted street will be a misdemeanor arrest. I have personally been arrested more than 40 times on misdemeanor charges and most longtime vendors have been arrested numerous times as well. This is the single worst law I've ever seen. "Right now, criminals have a blank check when it comes to their number of misdemeanor convictions," said bill sponsor Guy Velella (R-Bronx). Under the bill, a person charged with a misdemeanor after being convicted of three previous misdemeanors within 10 years would be considered a felon and face at least 11/3 years in state prison. East Side rape suspect Kevin White had 27 arrests on his rap sheet since 1989, but never spent more than six months behind bars because he often plea-bargained down to misdemeanor charges. Gov. Pataki, who initially proposed the bill in 2000, hailed the Senate for passing it again and called on the Democrat-controlled Assembly to vote on it immediately. "This legislation will help take dangerous criminals like Kevin White off our streets and prevent innocent people from being victimized," Pataki said. He added: "It is common sense that perpetrators with multiple misdemeanor convictions should face stiffer penalties for their repeated criminal activity."
