Without discussing the validity of the Forgent JPEG patent, I'd like to point out that there has been a good deal of disturbing news in the Intellectual Property area lately. The legal machinations of the SCO Group are only the tip of the iceberg, almost literally. Software patents are becoming a major point of contention in the European Union, and there were demonstrations in Brussels against them just a few weeks ago (see http://swpat.ffii.org/index.en.html for more information). The trend of companies claiming ownership over things that they have not actually designed or invented is not new. Probably the most famous and egregious example is that of the Selden patent (see http://www.bpmlegal.com/wselden.html for more information). Over 100 years ago, a patent lawyer named George Selden managed to convince the entire automobile industry into paying him royalties for every car they built, owing to a patent he owned. He sold the patent to a consortium of auto manufacturers, who refused to allow a fellow named Henry Ford to build cars under the patent. The consortium took out ads warning potential auto buyers not to purchase unlicensed automobiles, because they would be sued. So here we have patents, IP law, monopolistic attempts to keep newcomers out of an industry, and legal threats against end users. Not much has changed in 100 years, at least where lawyers are concerned! Oh yes, Henry Ford won the inevitable lawsuit. And Selden never did manage to make a successful car. -- David Fiedler 1.
