IN OUR VIEW Dodging the MATRIX bullet

It's been said that if you go with your first instinct, you're usually
right. Unfortunately, Utah is second-guessing its initial decision to pull
out of an anti-terrorism data-mining project that raised significant privacy
concerns.

In December, Gov. Olene S. Walker withdrew from the Multistate
Anti-Terrorism Information Exchange. MATRIX, as it is known, combined
information from local and state agencies, such as criminal backgrounds,
motor vehicle registration databases and driver license records, with
hundreds of publicly available databases. The idea is to get as much
information as possible on possible terrorists and other suspects.

Walker expressed concerns about protecting people's privacy and how much
oversight Utah would have for the system. Civil liberties advocates warned
that the database could be abused to snoop on innocent people, á la Big
Brother in George Orwell's novel "1984."

Former Gov. Mike Leavitt authorized participation in the database before he
resigned to head the U.S. Environmental Protection Agency. Walker, who was
Leavitt's lieutenant governor, said she was unaware of the arrangement.

Now, the Utah Technology Commission wants to revisit the issue and determine
whether legislation is needed to give the commission or some other entity
oversight for the state.

MATRIX proponents say it will allow police to look up information more
quickly and give them better information. That may be true, but the
potential for abuse looms large.

MATRIX is eerily similar to the Pentagon's proposed Total Information
Awareness program, created by Iran-Contra conspirator John Poindexter to
sift through all kinds of information, public and private, to determine who
is a terrorist. That program was scrapped because of the potential invasion
of privacy created by going through Americans' personal data.

While MATRIX would only use public records and only track criminal or terror
suspects, future political circumstances cannot be guaranteed.

Legislative oversight provides little reassurance. History has shown that
power corrupts, and the powers granted by MATRIX are just a bit too tempting
for comfort.

Even relatively innocuous U.S. Census data aided paranoid U.S. officials in
tracking down Japanese-Americans living on the West Coast during World War
II and shipping them to internment camps such as the one at Topaz in Millard
County.

Who is to say that government may not use MATRIX to resurrect TIA quietly,
or turn its data-mining activity to private records, or convert it into a
means of tracking critics of the government?

The Sept. 11 attacks didn't occur because government was unable to get a
look at the credit histories of Muslims. The FBI and CIA dropped the ball
because they didn't communicate with each other, a problem we believe
Congress has now solved.

A broad and aggressive grab for private information goes too far. Walker was
right. Utah needs to keep MATRIX unplugged.
