New gagging order on former MI5 spy

THE Attorney-General won a final injunction yesterday against the former MI5 agent David Shayler, preventing him from disclosing information obtained during his employment.
The move at the High Court in London came after the granting of an interim order against Mr Shayler in September 1997, which has remained in force.
The Attorney-General asked for summary judgment and a final injunction after the conclusion of criminal proceedings against Mr Shayler, which began with his conviction under the Official Secrets Act in November 2002, for which he was sentenced to six months.
In July 2003 the Court of Appeal rejected Mr Shayler’s application for permission to appeal against conviction and an application to the European Court of Human Rights was also rejected in April 2005.
Philip Sales, appearing for the Attorney-General, told Mr Justice Eady that there was concern that Mr Shayler was likely to continue to make disclosures if not restrained.
The final injunction was amended to prevent disclosure of information obtained during his time in the service — and also that which was said to have been so obtained. That is because false information is as capable of causing damage as accurate information.
Making the order against Mr Shayler, the judge said that he was satisfied that Mr Shayler had no prospect of success at a civil action trial in relation to the issues connected to the criminal conviction. He made a costs order against Mr Shayler.
