Judge considers union attempt to overturn NAFTA

BIRMINGHAM, Alabama (AP) -- The Clinton administration asked a federal
judge Monday to throw out a union-backed lawsuit challenging the North
American Free Trade Agreement as unconstitutional.

A government lawyer said no court has ever required a president to withdraw
from a pact like NAFTA, which critics blame for the loss of 400,000 American
jobs.

"Under international law we are not allowed to say, 'Sorry, Mexico. Sorry,
Canada, we didn't do this right,'" Justice Department lawyer Martha Rubio
argued during a hearing.

Jeremiah Collins, representing the United Steelworkers of America, said the
trade deal was approved by too small a majority in Congress five years ago
and has since become a "gigantic millstone" for U.S. industry. The lawsuit
centres on whether NAFTA is a trade agreement -- as the administration
contends -- or a treaty, as the union argues. Both houses of Congress
approved NAFTA on simple majority votes in 1993, indicating it was a trade
agreement. The lawsuit contends NAFTA is really a treaty and should have
been subject to a two-thirds majority vote in the Senate, as required by the
U.S. Constitution.

U.S. District Judge Robert Propst issued no immediate decision on the
lawsuit, filed in Birmingham because hundreds of Alabama steelworkers
blame job losses on NAFTA.

U.S. lawmakers approved NAFTA at the urging of President Bill Clinton in
1993, reducing tariffs and lowering regulatory hurdles with the goal of
increasing trade between the United States, Mexico and Canada.

The administration contends the deal has been a success, citing increased
U.S. exports and improved relations between the United States and Mexico.

Opponents say NAFTA has drained jobs from the United States by
encouraging companies to relocate to Mexico, hire low-paid workers and
import goods back to the United States.
