Charge Reinstated Against Hubbell
WASHINGTON (AP) -- A federal appeals court reinstated a criminal charge that
Webster Hubbell engaged in a scheme to conceal legal work he and Hillary
Rodham Clinton did on a fraudulent Arkansas land deal.
The three-judge panel unanimously rejected on Tuesday Hubbell's argument that
one of 15 charges against him should be dismissed as too vague. His trial is
to begin Aug. 9.
An 85-paragraph section of the indictment enumerates some 50 alleged lies by
Hubbell over a six-year span to regulators from the Resolution Trust Corp.
and the Federal Deposit Insurance Corp.
``It cannot be the case that the more elaborate the scheme or the more
numerous the acts of concealment, the less able the government is to charge a
crime,'' said the court decision. The judges were Stephen Williams and
Laurence Silberman, Republican appointees, and David Tatel, a Clinton
appointee.
``Hubbell's ... argument that the indictment fails to give sufficient notice
because it provides too much detail is, to be charitable, unconvincing,'' the
court added.
U.S. District Judge James Robertson had ruled that the allegations against
Hubbell were not specific enough.
Federal regulators say the land development involved, a 1,050-acre tract
south of Little Rock called Castle Grande, was riddled with insider dealing
and fictitious sales.
The project was owned by Mrs. Clinton's former Whitewater partner, Jim
McDougal, and Hubbell's father-in-law, Seth Ward. Mrs. Clinton has testified
repeatedly that she remembers almost nothing of her work on Castle Grande in
1985-86. Her work on the project was disclosed when her missing law firm
billing records turned up in the White House family residence in 1996 under
still-unexplained circumstances.
Castle Grande cost McDougal's savings and loan close to $4 million. The
government eventually took over the failing institution at a cost to
taxpayers of $65 million.
