If I recall correctly, the "conspiracy" described herein was really
INITIATED by the county prosecutor, here mentioned (typically) only in a very
understated way.
The prosecutor was just fleshing out a quota, in the course of further
building up his resume, so that, like most prosecutors, he could move on up
to an even more powerful unjustly-punitive office such as DA, judge, or --of
course-- POLITICIAN.
Wrongfully convicting the innocent --through concealing or destroying
exculpatory evidence, ordering witnesses to lie, or worse-- is today's
guaranteed ticket to the top. According to a recent Chicago newspaper
study, nationwide, such convictions are ROUTINELY pursued by prosecutors IN
FULL KNOWLEDGE that the defendant is innocent and the attorneys are breaking
the law and violating their legal code of ethics, because misconduct by
PROSECUTING attorneys is something that is RARELY IF EVER actually punished
by the legal system. (This case is one of them rarities.)
And the two top candidates for wrongful conviction? "Sexy" issues for
the DA as a future politician, reliably brain-fogging for the juries -- drug
and child-molest charges.
Jury Gets Case in Conspiracy Trial

WHEATON, Ill. (AP) -- The conspiracy trial of five lawmen accused of
railroading a man for the slaying of a 10-year-old girl went to the jury
Thursday after defense attorneys said the man's testimony was riddled with
lies.
Several jurors chuckled as attorney Brian Telander ridiculed Rolando Cruz for
the many contradictions and admitted lies he was confronted with when he
testified that he never made an incriminating statement to detectives.
``This guy lied so much that his name should be Pinocchio, not Rolando,''
Telander said.
He also highlighted Cruz's admission on the witness stand that he is seeing a
psychiatrist and working on his problem with lying.
But special prosecutor William Kunkle argued that a history of questionable
actions, nonexistent reports and evolving statements prove the four county
sheriff's deputies and an ex-county prosecutor lied and concocted evidence
against Cruz.
He was twice convicted and spent nearly a decade on death row for the 1983
rape and bludgeoning death of 10-year-old Jeanine Nicarico of Naperville.
The authorities ignored evidence that another man may have committed the
crime alone because it conflicted with their overzealous pursuit of Cruz,
Kunkle said.
Cruz was acquitted in 1995 at his third trial, when a dramatic change in
testimony by one of the deputies cast doubt on the contention that Cruz gave
two sheriff's detectives incriminating details in a May 9, 1983, statement
describing a ``dream'' or ``vision'' about the crime.
No police report was ever made on Cruz's alleged statement, and Kunkle
contends the detectives made it up.
The defendants are charged with conspiracy to obstruct justice and conspiracy
to commit official misconduct. The deputies face additional charges,
including perjury.
