technically "state" churches and must remain unpartisan. They must abide
by the IRS rules.
They could un-incorporate by cancelling their IRS 501(c) status. Then they
could do whatever they wanted without government interference. The first
amendment applies. And the government may NOT tax a non-501(c)
unincorporated church. A church is a group of individual people who have
already paid income taxes. Taxing a church is double taxation. The
fallacy lies in the thought that a church could be a corporation. When a
church incorporates it voluntarily gives up some Constitutional rights and
comes under the IRS rules. Just as one gives up certain rights when they
sign the 1040 income tax form.
Many churches are now finding out that they do not have to incorporate and
there are many new "Unregistered" churches springing up all over. The feds
hate it, hence, Waco. But then the Feds hate the Constitution, too.
The God of incorporated churches, by the churches own free will, is the
Federal Government.
Unregistered churches owe no allegiance except to Jesus Christ.
I wonder what the status of "The People For The Socialist Way" is.
