SB 365, a ballot access bill that will increase
the burden for third party candidates to get
on the ballot in California, was scheduled for a
hearing yesterday, Monday, June 21, in the
Assembly Elections Committee.

However, that hearing was postponed until Thursday,
June 24, at 10:30 AM.

If you haven't yet contacted the members of
the Assembly Elections Committee and urged them
to vote NO on SB 365, you have two more days
to do so!

WHAT TO SAY:
- ------------

    Here are some "talking points" you can use to express your
opposition to SB 365:

    (1) SB 365 is unfair to third parties.  Since third parties
almost exclusively collect signatures in lieu of paying the
filing fee, third parties will be most affected by the provisions
of this bill.  Democrats and Republicans will enjoy an even
greater advantage over third parties than they do now.

    (2) SB 365, which is intended to reduce confusion for candidates
and facilitate the filing process, will actually accomplish the
exact opposite.  By requiring more paperwork, more signatures, and
more filing, SB 365 will increase the workload for County Clerks and
create even more confusion for candidates.

    (3) SB 365 is a disservice to voters.  To the extent that third
party candidates do not qualify for the ballot because of the bill's
requirements, SB 365 will eliminate different alternatives for voters
in the voting booth.  Choices for voters will be limited and narrower.

    Be brief and courteous, but make your point emphatically.

    If one of the committee members is your representative, be sure
to tell them that you are a constituent!  If you aren't sure who your
State Assembly representative is, you can find out by going to
http://www.senate.ca.gov/~newsen/senators/yoursenator.htp.


THE BACKGROUND:
- ---------------

    SB 365 by Senator John Lewis (R-Orange) will
complicate the signature gathering process for third
parties.

    Under current law, candidates may collect signatures
in lieu of paying a fee when filing a declaration of
candidacy.  In addition, all candidates are required to
collect a certain number of nominating signatures.
Signatures collected in lieu of the filing fee also count
towards the nominating signature requirement.

    Under SB 365, that "dual-use" of signatures would be
eliminated.  Candidates would be forced to collect
signatures twice, during two separate time periods, and
the signatures would be counted independently of each
other for purposes of meeting the required amounts.

    Collecting signatures from voters is difficult enough once,
let alone having to do it twice.  As a result, fewer third party
candidates are likely to qualify for the ballot.  In addition,
the Libertarian Party and other third parties will face greater
difficulty recruiting candidates once the signature gathering
process is explained to potential recruits.

    SB 365 must be stopped!

    Unfortunately, SB 365 is being sponsored by the California
Association of Clerks and Elections Officials, a government
employee lobbying group.  SB 365 was passed by the State
Senate on May 25, 39-0.

    We have two more days to kill this bill!


WHAT YOU CAN DO:

    *Call, fax, or e-mail the members of the Assembly Elections
Committee and urge them to vote "NO" on SB 365.

    *Be sure to pass this Action Alert along to your friends,
neighbors, and
associates who live in California and who might care about the
survival
of third parties.
