UPDATE: Lawsuit against Clinton on Legality of Clinton Starting a
War without Congressional Approval Scheduled for Oct 22, 1999

Update 08/23/99:

On June 16, 1999, Congressman Tom Campbell along with thirty
other Members of Congress appealed the June 8 dismissal of their
lawsuit (Case# 99-1072) against President Clinton to the U.S.
Court of Appeals for the District of Columbia Circuit. On June
18, the Court of Appeals accepted their appeal on an expedited
basis, and all briefing was completed on August 3, 1999. Oral
argument, if granted, will occur within ten days thereafter. The
appeal case number is 99-5214.

BACKGROUND: On April 28, 1999, Congress voted overwhelmingly
against declaring war against Yugoslavia (H.J. Res 44) and
defeated a concurrent resolution (S.Con. Res. 21) to continue the
air war. On April 30, 1999, a bipartisan coalition of Members of
Congress filed a lawsuit to compel the President to follow the
Constitution and halt U.S. armed forces from engaging in military
action in Yugoslavia unless we declare war, or grant him specific
statutory authority.

Below is the United States Court of Appeals for the District of
Columbia Circuit's current oral argument calendar for the
remainder of the 1999-2000 term. All arguments, unless otherwise
noted, are held in the Court of Appeals Courtroom on the fifth
floor of the E. Barrett Prettyman United States Courthouse. In
consolidated cases, only the lead docket number is listed. The
cases are listed in the order in which they will be argued.
However, this order is not guaranteed and is subject to change at
any time. The time allocated for oral argument is listed to the
right of the case caption. Time allocations are established
approximately two weeks prior to oral argument. Arguing counsel
should arrive in the Courtroom by 9:15 a.m. to check in with the
Courtroom Deputy. Counsel arguing in the afternoon sessions
should arrive no later than 1:45 p.m.
