                  Statement regarding DPS Tear Gas Round Investigation.

        As the DPS said shortly after the fire at the Branch Davidian
compound in 1993, the Ranger
        inquiry, which was requested by the U.S. Department of Justice,
would be the most
        complicated in the organization's history.

        Nearly a third of the Texas Ranger Division, working with DPS crime
lab personnel, DPS
        Special Crimes investigators and other DPS personnel, collected
thousands of pieces of
        evidence at the scene. Though the fire occurred six years ago, the
DPS undertook the renewed
        inquiry in June, at the direction of DPS Public Safety Commission
Chairman James B.
        Francis Jr. in response to questions raised concerning some of the
evidence. We think it is
        important to make this point:

        The DPS is not investigating the FBI or the U.S. Department of
Justice. Once the Rangers
        have completed their inquiry, the results will be sent to the U.S.
Attorney's Office in Waco,
        which has jurisdiction in this matter. In response to other
frequently-asked questions:

        1. The DPS must limit its public comments concerning this matter
because of a pending civil
        suit since evidence collected by the DPS will be a factor in the
trial.

        2. The current DPS inquiry started in June.

        3. The findings of the current inquiry, which is nearly complete,
will be made available to the
        U.S. Attorney's Office.

        Any action taken after that point would be up to the Justice
Department.
