5 county cops are indicted

             October 2, 1999

             BY FRANK MAIN AND MOLLY
             SULLIVAN STAFF REPORTERS

Five Cook County sheriff's deputies were
indicted Friday for allegedly chasing and
opening fire on a vehicle after they had
attended a cocktail fund-raiser for Sheriff
             Michael F. Sheahan.

Two deputies--the driver and the sergeant
who allegedly fired the shots--are charged
with attempted murder and could face up to
             30 years in prison.

The deputies are white and the couple in the
vehicle, Cory Simmons and Dominique Mapp,
are black. But prosecutors found no evidence
of a hate crime, Cook County State's Attorney
             Dick Devine said.

No racist comments were made during a 911
call by one of the deputies, as previously
alleged, Devine said. "It's the firing act into the
vehicle during the course of the chase which is
             beyond the pale," he said.

Neither Simmons, 23, a Chicago Transit
Authority painter from south suburban Hazel
Crest, nor Mapp, 20, of Chicago, was injured.
But a bullet lodged inside Simmons'
sport-utility vehicle just inches from his head,
said his mother, Sharon Hinton of Hazel Crest.

"They could have killed my son," Hinton said,
adding that she prayed for charges against the
deputies, but did not think they would be
             prosecuted.

Sgt. Thomas Lanigan, 34, and deputy Anthony
Bohling, 32, are charged with attempted
murder and aggravated discharge of a firearm.
They and deputies Andrew Remus, 37; Robert
             Jones, 29, and ex-deputy Daniel Troike, 27,
also are charged with official misconduct and
             obstruction of justice.

The incident took place at about 11:15 p.m. on
June 2. Simmons was driving a Ford
Expedition at 167th and Pulaski when he cut
off a Chevy Suburban driven by Bohling,
authorities said. The off-duty deputies yelled
foul language and the chase began, officials
             said.

The deputies had just attended a fund-raiser
for Sheahan at Comiskey Park and later were
seen drinking at a South Side bar where
             Sheahan had been, officials said.

After a 30-minute chase through the south
suburbs, Lanigan allegedly leaned out of a
passenger-side window and fired several shots
into the Expedition. Simmons drove to the
             Robbins Police Department, whose officers
stopped the five deputies. They appeared
             intoxicated, Robbins police said.

On Friday, Sheahan suspended Lanigan and
stripped Bohling, Remus and Troike of police
powers, putting them in administrative duties.

Bohling, who did not fire a shot, was charged
with attempted murder because he was behind
             the wheel, sheriff's spokesman Bill
Cunningham said. Under state law, a driver is
responsible for the conduct of his passengers,
             he said.

The sheriff launched an internal investigation
             Friday, Cunningham added.

Lanigan is the nephew of Sheahan's former
partner on the Chicago Police Department,
Cunningham said. Attorneys for the deputies
could not be reached for comment.
