'PERSECUTED' CLINTON KEPT LEWINSKY PRESS CLIPPINGS IN DESK; CALLED IN
'RICHARD JEWELL FILE'

During the frenetic first weeks after the eruption of the Monica
Lewinsky scandal, in January of last year, President Clinton kept
what he called the 'Richard Jewell file' in his desk, Jeffrey
Toobin reports in the November 15, 1999, issue of the NEW YORKER,
hitting racks on Monday

Clinton identified with Jewell, the former Atlanta security guard
who was wrongly suspected of planting a bomb at the Olympics in
1996, Toobin writes, and Clinton kept in the secret file
newspaper articles about what he regarded as the unfair attacks
on him.

Toobin reports that it was not only at the White House but also
at Independent Counsel Kenneth Starr's office that the Lewinsky
drama became extraordinarily personal.

In fact, Toobin writes, the President came far closer to losing
his office than is generally supposed!

Starr's office may have presented a united front after the story
broke on the Internet, but it was torn by an internal struggle.

Toobin wirtes that one critical battle concerned a key question
in the case: whether Starr's office should offer Lewinsky
immunity from prosecution.

Two of the most experienced prosecutors on Starr's staff, Bruce
Udolf and Michael Emmick, conducted the negotiations with
Lewinsky lawyer Bill Ginsburg.

Ginsburg refused to let the prosecutors interview Lewinsky
directly, but he did allow her to write a description of her
relationship with Clinton.

Based on this document, the Office of the Independent Counsel,
represented by Udolf and Emmick, faxed a three-page immunity
agreement to Monica Lewinsky's lawyers on February 2,1998, only
eight days after President Clinton told the nation that he had
had sex with "that woman, Miss Lewinsky."

Toobin reports, In a meeting on February 3rd, the Starr's
prosecutors battled fiercely over whether they should in fact
enter into the agreement with Lewinsky. Most of them, led by
prosecutors Jackie Bennett and Robert Bittman, argued that
"Emmick and Udolf had wimped out."

Bennett and Bittman argued that Starr should not allow himself to
be pushed around by Ginsburg, a lawyer they considered a
grandstander.

Emmick and Udolf responded that their fellow-prosecutors should
forget about Ginsburg and focus on what Lewinsky could give them
as their only real witness in the case against the President.

'STARR DELAY SAVED CLINTON'

Starr sided with Bennett and Bittman and no agreement was made,
delaying the eventual disclosure of Monica's story by six months,
a delay, Toobin contends, that saved the Clinton Presidency.

"Starr," he writes, "could have had an impeachment report before
Congress as early as the end of February; instead, it was
delivered to the House in September."

"His decision marked the precise moment when Bill Clinton's
survival in office became assured," Toobin argues, suggesting
that "if Starr had agreed to the immunity deal on February 3rd,
he would have had the evidence, in testimony and in conclusive
genetic evidence, a semen-stained dress, to prove that Clinton
had deceived the nation.

Clinton's defenders had not yet had time to change the subject,
writes Toobin.
