An urban legend is a story or account that many would think is true but which in fact is not true.  If the subject event occurs once, whether frequently or not, it is a true event; because it is true it cannot be legendary. 
 
The urban legend, therefore, refers to whether the thing does happen not that it happens once in awhile or frequently.  And if it in fact happens the legend is no more fairytale.
