Do you really think this stuff is accidental ? http://www.vny.com/cf/News/upidetail.cfm?QID=61839 Ex-CIA chief's computer use scrutinized Thursday, 3 February 2000 0:33 (ET) Ex-CIA chief's computer use scrutinized By PAMELA HESS WASHINGTON, Feb. 2 (UPI) Unauthorized outsiders were in a position to gain access to state secrets that former CIA director John Deutch had stored on his home computers in violation of agency rules and possibly federal law, according to senior intelligence sources. The sources said Deutch, who was stripped of his security clearances in August, two years after he retired from the CIA, was in electronic mail contact with someone who identified himself as a Russian scientist. His computer was also used to access "high risk" Web sites, including pornographic sites. Deutch lost his access to the nation's top-secret information when it was revealed that he had regularly created top-secret documents on CIA-issued personal computers in his home that were not cleared to handle such sensitive information. CIA Director George Tenet said Wednesday there was no way of knowing whether any information Deutch put into his unclassified computer was intercepted by foreign governments or hackers. "We don't exclude the possibility," Tenet testified before the Senate Select Committee on Intelligence. "I can't tell you it has or has not occurred." "There is no evidence to suggest that it happened," he said. Tenet said Deutch put "enormously sensitive material" at the highest level of classification on his unsecured Macintosh home computer which was connected to the Internet. "He was sloppy in what he did," Tenet said of his friend and predecessor. "He worked around the clock. He didn't think about what he was doing. Nevertheless...as director I believe he should have known better." Computers that don't have exceptional security devices and are connected to the Internet run the risk of having their hard drives examined, copied, altered, or wiped out by hackers. In light of that vulnerability, the Defense Department and CIA put top-secret information on secure private networks inaccessible without a special computer and software. Deutch, who headed the CIA from May 1995 to December 1996, opted not to have the special system in his home and, instead, wrote many documents on his personal computers. Sources said secrets were in a position to be compromised because Deutch used the computer for e-mail and was in contact with someone who could have been a foreign agent. Tenet said Deutch did not transfer information from the CIA's secure system to his home computer, but instead created documents that he would later put into the secure system. Ironically, Deutch was one of the first government officials to raise the flag about how vulnerable computers are to information attacks. "We have evidence that a number of countries around the world are developing the doctrine, strategies and tools to conduct information attacks," Deutch told Congress in 1996. The CIA knew Deutch was using his home Macintosh computer to write and store highly classified documents, at least in 1997, after Deutch retired. The agency took no action -- failing to notify the Justice Department and Congress -- until August when Tenet suspended Deutch's security clearances. Tenet admitted the CIA botched the handling of security breaches by Deutch, but insisted that the agency made up for its slow response by revoking Deutch's security clearances, which Tenant said is a strong measure that is not regularly used. "In his case, we went the extra mile because of his leadership position," Tenet said. Deutch said in a written statement last August: "While serving as Director of Central Intelligence, I erred in using CIA-issued computers that were not configured for classified work to compose classified documents and memoranda. While it was absolutely necessary for me to work at home and while on travel, in hindsight it is clear that I should have insisted that I be provided the means of accomplishing this work in a manner fully consistent with all the security rules." In fact, according to a Feb. 1 New York Times report, Deutch objected to having a secure system installed in his home as well as the attendant security officer that comes with it. Deutch's top-secret home office was revealed as he was leaving the CIA to resume teaching at the Massachusetts Institute of Technology. Security officers who went to his Washington home to retrieve his CIA-issued equipment discovered classified files on his personal computer. The Times said a classified report by the CIA's inspector general claimed this was a potential violation of agency rules and federal law. The investigation, however, was shelved after a few months. Tenet and other CIA officials were informed immediately of the possible breach. The CIA did not inform the Justice Department for more than a year. The agency's inspector general's office told Justice in early 1998, but the Justice Department said in April 1999 that they would not pursue the case. Tenet told the Senate panel Wednesday that there is no excuse for how the CIA handled the matter, particularly with regard to notifying Congress and the Justice Department. "That should have been done promptly," he said, "certainly by the spring of 1997 when internal reviews had been completed....But my view is that when you have a case involving a director, the notification should have been prompt. And there's no excuse for that. And we should not have assumed that it happened, and it should have happened." Tenet defended the CIA's performance, however, by pointing out that the punishment for Deutch, who once had access to the nation's deepest secrets, is severe. "The action we took against the director was unprecedented in its scope because we believe that everybody has to be treated equally," he said, "whether at the top of the chain or the bottom of the chain, so that the men and women that work for us understand that there are not two standards." Tenet said the executive director of the agency is conducting a review to see why no one, including Congress, Justice Department, or the FBI, was notified about the potential security breach. The review will examine everyone's role throughout the chain of command, including Tenet's. "I think there is a process here that's working extremely well," Tenet said. "Didn't work in this case as well as it needed to, but we have a process in place that we pay a lot of attention to, and I think the record's a good one." "We make no excuses," he said. "We were in a period of great transition. We were dealing with a former director. People were trying to do their best job. At the end of the day, we now know that we all could have done this better; the entire system could have performed better." But Tenet insisted the secretive and publicity-averse CIA can "police itself" adequately and said he holds his agency to the highest standards of professionalism and honor. "Some people say, 'Can the CIA police itself?'" he said. "Well, we take a lot of pride in our own internal accountability, in our professional responsibility, in conducting ourselves honorably, and ensuring that this committee and the American people believe that.
