August preliminary hearing set despite Nichols' plea for time

Terry Nichols wanted more time, but a judge chose Aug. 7 to begin his
preliminary hearing in the Oklahoma City bombing case.

"Lawyers are able to do an incredible amount of work when they have a
deadline," Payne County Associate District Judge Robert M. Murphy Jr.
said Friday.

The preliminary hearing will determine whether the evidence against
Nichols is enough for a murder trial. The judge estimated the hearing
could take three to six weeks.

Nichols, 44, was serving a life sentence on his federal conviction for
plotting the bombing, but state prosecutors charged him to seek the
death penalty.

The April 19, 1995, attack on the Alfred P. Murrah Federal Building left
168 dead.
The judge Friday also imposed a ban on out-of-court comments and
resolved a dispute over the copying of FBI files. He scolded attorneys
at one point "to not behave like children."

Friday's hearing was again held in the basement of the Oklahoma County
jail. Only two victims were present.

Before it started, Nichols smiled, waved and mouthed, "Hi," to victim
Kathy Wilburn, who is corresponding with him by mail.

Wilburn, who lost her two young grandsons in the attack, believes there
are others -- still not caught -- involved in the bombing. "I'm
interested in getting to the truth. Terry probably has more pieces of
the truth," she said.

The decision on a preliminary hearing was a compromise. Prosecutors
wanted to start sooner but defense attorneys wanted longer to review the
hundreds of thousands of pages of FBI reports. Attorney Brian Hermanson
said he'd need 16 years if he read everything -- even at a page a
minute, eight hours a day, five days a week.

The ban on out-of-court comments -- known as a gag order -- was sought
by both the prosecution and defense.

The next hearing is 3 p.m. March 3. The judge rescheduled a hearing on
cameras in the courtroom to March 10.
