 Deputy Attorney General Eric H. Holder Jr. confirmed yesterday that
 his office was involved in the Justice Department's decision to
 seek the death penalty against Carl Derek Cooper in the Starbucks
 slaying case. But he would not disclose the reasons U.S. Attorney
 Wilma A. Lewis's recommendation against seeking execution was
 overruled.

 "I will say that the deputy attorney general's office was involved,
 but I really wouldn't want to comment on what my role, if any, was
 in that matter," Holder told reporters during a weekly news
 briefing at the Justice Department yesterday.

 Sources familiar with the Cooper deliberations said Holder was
 among those supporting Attorney General Janet Reno's decision to
 seek the federal death penalty. Reno had the final say on the issue
 and acted Monday after receiving recommendations from Lewis and a
 Justice Department screening committee as well as input from Holder
 and other officials.

 The decision has generated criticism from Del. Eleanor Holmes
 Norton (D-D.C.) and other political leaders who maintained that
 Reno should not have chosen to target Cooper and the Starbucks case
 for the first death penalty trial in the District in nearly 30
 years. Unlike federal law, the District has no provision for the
 death penalty.

 Lewis has declined to discuss her stance on the case, but other
 sources said she did not believe that the federal issues were
 strong enough to push for death.

 Holder was U.S. attorney for the District from 1993 until 1997,
 when he became second in command at the Justice Department. As U.S.
 attorney, he expressed misgivings about capital punishment. As U.S.
 attorney, he usually was forthcoming, even on touchy subjects. But
 he would not comment yesterday on the dynamics of overruling his
 successor, Lewis.

 In 1995, Reno persuaded Holder to seek the federal death penalty
 against Donzell McCauley in the killing of a D.C. police officer.
 Holder ultimately accepted a plea bargain with McCauley that
 resulted in a life prison sentence with no chance of parole. At the
 time of the plea, Holder explained that a death penalty trial could
 divide the city and said that the District's long-standing
 opposition to the death penalty gave prosecutors reason to worry
 that a jury might not go along with a death sentence.

 Holder's remarks yesterday suggested that he now views cases in a
 different perspective because of his expanded responsibilities.

 "Federal cases have to be judged on a nationwide standard," Holder
 said. "We have one system, and it is appropriate for people in the
 federal system all to be treated in the same way. And that's one of
 the things that we try to search for, especially when it comes to
 the death penalty."

 Cooper, 30, is to stand trial May 2 in U.S. District Court on
 capital charges stemming from the July 1997 slayings at the
 Starbucks coffee shop in the 1800 block of Wisconsin Avenue NW.
 Prosecutors said the victims -- store manager Mary Caitrin Mahoney,
 25, and employees Emory Allen Evans, 25, and Aaron David Goodrich,
 18 -- were killed in an apparent robbery attempt. Cooper also faces
 racketeering and other federal charges involving a series of
 shootings, robberies and other crimes dating to 1993.

 Now I thought the DOJ was currently reviewing the accusation that
 Blacks get unfair treatment in the justice system and that they get
 a disproportionate amount of death sentences. So what do they do?
 Despite all the murders that occur in DC they pick on a black man
 to single out for the death penalty.

 coinkydinky- not suspicous at all coming from a guy who makes deals

 counsel, as this one will *not* go to just any public defender.

 It'll also be interesting to see if Chelsea gets called as a
 witness, based on her previous visit/s to the Starbucks where the
 murders took place and her personal relationship with former White
 House Intern Mahoney.

 Interestingly, Mahoney's mother is an employee of a prosecutor's
 office, in Baltimore, I believe- not certain if local or fed. There
 should be some stirrings in the media there for alert local
 freepers to note and report upon.

 what is left out than what is included. For instance, Monica
 Lewinsky's "tell all" book does not even mention Mary Mahoney. Now
 if you were writing a book about your duration in the WH, wouldn't
 the brutal murder of a co-worker be noteable? This sleight of hand
 requires that you look in the opposing direction. Like an "apparent
 robbery", with no money taken.

 Well said. It's the foundation for the past century of propaganda
 and misinformation. It's much more effective to leave out a truth,
 than to include a lie. Because if you include a lie, there it is,
 ready to be checked and challenged. But if you omit a truth, it's

 Francis D. Carter, the lawyer who helped Monica "arrange" her
 affidavit to keep from having to testify, is one of Cooper's
 lawyers.

 IMHO, his job, as dictated by the "powers that be" is to CONVINCE
 Cooper to cop a plea, guilty, to avoid trial THEREBY ensuring that
 discovery and testimony will NOT OCCUR.

 By the Administration asking for the death penalty and treating
 this as a Federal crime rather than a D.C. crime, they have
 LEVERAGE...something to convince Cooper NOT to go to trial on
 capital charges. I'm sure Carter's job is to talk him into it, to
 keep all this stuff "undisclosed" which would happen in a public,
 open trial!

 Yep, as far as we know it is indeed a myth. This quote rumored to
 be on a tape or elsewhere in the Starr referral, but it was never
 credibly sourced, and when it finally came out, it was no where to
 be found. This hasn't stopped it from surfacing since, most
 recently in The Globe (yet another reason to think that tabloid
 article was laying a false sex-harrassment trail to keep our eyes
 off the China connection). The closest reference was Monica saying
 she didn't "want to end up like Mary Jo Kopechne." It is possible
 references to Mahoney of some sort were contained in redacted
 information (maybe even likely, given how much was redacted), but
 we really don't know.

 on Drudge and elsewhere? The White House ludicrously claimed later
 that was a fortysomething "old Arkansas neighbor of the Clintons."
 I suppose it's possible, but no one can really compare -- her face
 was blurred/pixelated out the whole time, except for a brief
 profile in a wide shot. Maybe Drudge has the unsmeared tape
 somewhere?

 former Assistant Attorney General Robert S. Mueller (who botched
 the BCCI case and helped convict Manuel Noriega) returned to the
 Justice Department in 1995 (after it was learned our nuclear

 FOR WASHINGTON DC. He remained in that position for most of the

 refuse to say whether Holder had any role in this decision? What
 was Holder doing meeting the press yesterday -- was this in place
 of Reno's weekly Thursday press conference?

 If Cooper had a decent defense lawyer, would he be able to get
 access to any of DOJ's internal deliberations? I would assume any
 death sentence could not survive the appeals process with a decent
 lawyer. Of course, the question is, how to make Cooper aware of
 that fact? Once he knew, the threat of the death penalty would lose
 most of its force in inducing him to cop a plea.

 Good question, and why is the Justice Department so hot on this??
 It was the cruel killing of 2 innocents, but the third,was a
 Whitehouse intern, maybe she knew tooo much about what was going on
 there. No evidence of theft in this "arkanside", just 3 dead kids??
 Why is the Justice Department going against this man, who may or
 maynot be the killer?? BTW he was forced into his confession.

 July 8, 1997: Mahoney's silver 1994 Saturn sat alone in the parking
 lot adjacent to Starbucks, where she had left it the day before.
 The only possible indication that something had gone awry was a
 flat tire on the front passenger side of the car. Inside, the car
 was spotless, save for what looked like signs that Mahoney had
 recently spent time playing with a pet -- a dirty tennis ball, a
 plastic chew toy, a dog's brush and a red towel.

 mentioned on Jeff Rense's show when he interviewed Carl Limbacher
 of Newsmax.com.

 My theory that Caitlyn was going to go public with sexual
 harassment might be correct. After all she didn't land a big

 I heard Carl Limbacher say on a radio clip that one William (some
 initial) Martin had been quoted in a newspaper article on the
 Starbucks case, and that he suspected -- but had not yet confirmed
 -- that this was the same Billy Martin who had been the lawyer of
 Monica's mother Marsha Lewis. Do you know of anything further
 connecting Martin and Cooper? I ask not just out of curiosity, but
 because I told Alamo-Girl I would tell her if and when I could
 confirm the connection.
