 .......Libby, this proposal for legislative action could be used as
 a backdrop to inject this health/environmental subject into the
 national election in California.....!!!  As you know, both John
 McCain and Al Gore are vulnerable on this issue......  They both
 have a record of kow-towing to the cell phone industry......
 (Remember, it was Gore who put into the 1996 TELCOM ACT the words
 that gave us the UNCONSTITUTIONAL provision that attempted to
 remove local control of tower siting decisions.....)

 Senator Tom Hayden introduced this legislation last week in the
 California State Senate (SB 1699).  The cell phone companies are
 already gearing up.  There will be hearings in Sacramento in March.
 This bill specifically refers to research findings which link cell
 phone use to "brain tumors, memory losses and genetic mutations".
 Also mentioned are the increased risk of "acoustic neuromas,
 a benign tumor of the auditory nerve, and increased risk of
 neuroepithelial tumors on the outside of the brain." The links to
 acoustic neuromas have been corroborated by Dr. George Carlo,
 former Director of The Wireless Technology Research Group, who
 conducted research for the Cellular Telephone Industry Association.

 The Bill calls for a review of the research literature on
 radiofrequency radiation; requires California retailers to post
 signs alerting consumers that "cell phones may be a health hazard"
 and requiring retailers to to offer "hands free devices" for sale
 at time of purchase; and, as of January 2002, if the literature
 review shows there is clear evidence of a health risk, the Bill
 would require retailers to sell hands free devices with each cell
 phone.

 The advent of this bill offers an enormous opportunity for
 increased general public awareness about the health hazards of cell
 phones.  The "hand free" manufacturers are promoting their products
 to prevent direct exposures to the brain by hand held devices.  It
 is not clear whether these products are effective.  As many of us
 know, the concerns over cell phones are only one aspect to the
 chronic and excessive exposures to emergent and rapidly changing
 wireless technologies.   This legislation and the issue it raises
 addresses consumer choices which can affect the marketplace.  It is
 important that this legislation not be diverted into a debate over
 which hands free device is most efficacious.  By emphasizing the
 major point -- cell phones are hazardous -- the public can be
 educated enough that they may be motivated to act, even if to
 protect their personal health.  The bill can also be used to
 advertise what the scientists are warning us about -- it is not
 enough to be concerned about the cell phones -- a periodic and
 excessive exposure to the brain from a transmitting device, it is
 also important to be concerned about the chronic long-term
 exposures from the transmitting cell towers and antennas.  Whether
 we own a cell phone or not, we all are being involuntarily being
 forced to live near to operating cell towers 24 hours a day, seven
 days a week.  Long term exposure to low level radiation from cell
 towers and antennas poses a public health risk too.

 I urge you to contact your California State representatives and
 ask them to support Hayden's legislation.  Be sure to attend the
 hearings in March.  If  the California State Health Department is
 asked to review the literature, the "official position" that there
 is harm can be taken.  There is enough research right now to make
 the case that cell phones are harmful.  The work of Drs. Ross Adey,
 Gerry Phillips and Henry Lai have been instrumental in showing
 harm.  The RF bibliographies of Dr. Neil Cherry place the science
 in context with other significant EMF research findings.  Based on
 the precautionary principle, there is enough information for
 lawmakers to act right now to protect public health.  Don't forget,
 It took much less research than this to get FDA to pull silicon
 breast implants from the market!!!  Let's let our legislators know
 what we think!  Let's stand behind Senator Hayden's bill.

 FEBRUARY 22, 2000

     An act to add Article 6 (commencing with Section 108670) to
 Chapter 5 of Division 104 of the Health and Safety Code, relating
 to cellular telephones.

          LEGISLATIVE COUNSEL'S DIGEST

     SB 1699, as introduced, Hayden.  Health:  cellular telephones.

     Under existing law the State Department of Health Services is
 authorized to commence all proper and necessary actions to protect
 and preserve the public health.

     This bill would require cellular telephone retailers to offer a
 hands-free earpiece or headset when a cellular telephone or service
 contract is sold within the state.

     This bill would require cellular telephone manufacturers to
 provide and cellular telephone retailers to post a placard at the
 point of sale.  The placard would state the possible health risks
 associated with cellular telephones.  In addition, the placard
 would be required to advise consumers how to protect themselves
 against radiation effects from cellular telephones.

     This bill would require the department to review existing
 surveys and research concerning the health effects of cellular
 telephones.

     This bill would require that unless the department determines
 that cellular telephones have no adverse health effects by January 1,
 2002, all cellular telephones sold after January 1, 2002, must
 include a hands-free earpiece or other device to provide protection
 against cellular telephone radiation.

     Vote:  majority.  Appropriation:  no.  Fiscal committee:  yes.
 State-mandated local program:  no.


 THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:


    SECTION 1.  Article 6 (commencing with Section 108670) is added
 to Chapter 5 of Division 104 of the Health and Safety Code, to read:

        Article 6.  Cellular Telephones

     108670.  The Legislature hereby finds and declares all of the
 following:

     (a) Cellular telephones play a vital role in expanding
 communication and information globally and are being marketed at
 accelerating rates.

     (b) Recent studies suggest the possibility of links between
 cellular telephone use and human health impacts such as brain
 tumors, memory loss, and genetic mutations.

     (c) A study funded by the Cellular Telecommunications Industry
 Association concluded that cellular telephone service users are at
 risk of acoustic neuroma, a benign tumor of the auditory nerve, and
 increased risk of neuroepithelial tumors on the outside of the
 brain.

    The same study found a positive correlation between the amount
 of cellular telephone service use and tumor development.

     (d) The federal Food and Drug Administration in October 1999
 concluded: "Available science does not allow us to conclude that
 mobile telephones are absolutely safe or unsafe."

     (e) It is inappropriate that critical health and safety studies
 lag behind the vast expansion of cellular telephone marketing.


     108671.  (a) Retailers shall offer a hands-free earpiece or
 headset for sale when a cellular telephone service or service
 contracts for cellular telephone services are sold in California.

     (b) Manufacturers of cellular telephones shall provide, and
 retailers shall post, an informative placard adjacent to the point
 of sale.  The informative placard shall advise consumers that
 academic studies show a possible link between cellular telephone
 service usage and brain tumors and memory loss and that federal
 studies are inconclusive.  The informative placard shall also
 advise consumers that a hands-free earpiece or headset provides
 health protection against radiation effects from cellular
 telephones. The informative placard shall be clearly printed,
 easily understood, and immediately visible adjacent to the point
 of sale.

     (c) The State Department of Health Services shall review
 existing surveys and research concerning the health effects of
 cellular telephones and adopt regulations or undertake additional
 research.

     (d) Unless the department determines cellular telephones have
 no adverse health effects by the appropriate state and federal
 authorities on or before January 1, 2002, all cellular telephones
 sold after that date shall include a hands-free earpiece or other
 device to provide protection against cellular telephone radiation.
